Initial Comments:
This report is the result of an off-site special monitoring survey conducted on March 13, 2024, at Physician's Care Surgery Center. It was determined the facility was not in compliance with the requirements of the Pennsylvania Department of Health's Rules and Regulations for Ambulatory Care Facilities, Annex A, Title 28, Part IV, Subparts A and F, Chapters 551-573, November 1999.

51.3 Notification

(c) A health care facility shall provide similar notice at least 60 days prior to the effective date it
intends to cease providing an existing health care service or reduce it licensed bed complement.

Observations:

Based on a review of facility documents and staff interview (EMP), it was determined the facility failed to notify the Department in writing at least 60 days prior to the effective date the facility intended to cease ASF (Ambulatory Surgical Facility) services.

Findings include:

An email from EMP1 dated February 20, 2024, revealed, "Please see the attached Closure Plan for Physicians Care Surgery Center " .

An email from EMP1 dated February 27, 2024 revealed the revised Closure Plan "Notification of closure was provided to the Pennsylvania Department of Health on January 4, 2024, for Phycare ASC LLC, dba Physicians Care Surgery Center ("Center")" .

An interview with EMP1 on March 13, 2024, confirmed "... the last case was performed on December 26, 2023" . EMP1 further confirmed the facility did not provide the Department the 60 days' notice.






Plan of Correction:

The facility is aware of the 28 Pa. Code Chapter 51 requirement 60-day notification and will ensure proper notification is provided to the PA Department of Health if any further changes are to occur.
